AMERICAN GLASS RESEARCH TERMS OF USE INCLUDING TERMS OF USE FOR PURCHASE OF WEBINAR ACCESS

These terms and conditions apply to e-seminars.americanglassresearch.com (the “Site”), provided by American Glass Research ("AGR" or "we"). AGR provides website features and makes webinars available to you for purchase either through the Site or through a third party (collectively, the "Services"). AGR provides the Services subject to the following conditions.

By using the Services, you agree to these Terms of Use. Please read them carefully.

If you do not accept these Terms of Use, you are not authorized to use the Site. We reserve the right to change these Terms of Use from time to time, and your continued use of this Site constitutes your acceptance of and agreement with any such changes. You must be eighteen (18) years of age or older (except in the case of legal residents of certain states where the legal age of majority is greater than eighteen (18) years of age) in order to use the Site or any Service. 

PRIVACY

You agree to be bound by the terms of our Privacy Policy (which is Here), which is incorporated herein by reference into these Terms of Use. We cannot insure that all personal information will never be disclosed in ways not otherwise described in the Privacy Policy. You may not, and these Terms of Use do not give you permission to, reproduce, reverse engineer, decompile, disassemble, modify or create derivative works with respect to the Site and any content, information or functionality contained therein. You may not remove any copyright, trademark or other intellectual property or proprietary notice or legend contained on the Site or its content.

Our trademarks ( and trade dress may not be used in connection with any product or service that is not ours, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits us. All other trademarks not owned by us that appear in any Service (such as the trademarks of the vendors whose names may appear on the Site) are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by AGR.

LICENSE AND ACCESS

Subject to your compliance with these Terms of Use, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the Services. This license does not include any resale or commercial use of any Service, or its contents; any derivative use of any Service or its contents; any downloading, copying, or other use of information for the benefit of any third party; or any use of data mining, robots, or similar data gathering and extraction tools. The licenses granted by us terminate if you do not comply with these Terms of Use. We have the right to terminate your use of and/or access to the Site and any Service at our discretion.

YOUR ACCOUNT

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.  You may not purchase any service provided by us  unless you are eighteen (18) years of age or older (except in the case of legal residents of certain states where the legal age of majority is greater than eighteen (18) years of age). We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.

WEBINARS

Webinars are to be viewed by the registrant only; the content must under no circumstances be recorded, reproduced or disclosed to any other party. 

We may provide various materials, information, quizzes, tests, questions, videos, articles, news and other information on this Site and related sites and in courses offered through this Site (the "Webinar Materials").  We grant each registrant a limited, nonexclusive license to view and download one copy of the Webinar Materials and use the Webinar Materials as set forth in these Terms of Use.

 No printed copies of the Webinar Materials is permitted. A printed copy may be purchased separately by contacting AGR. Webinar Materials and all copyright and other proprietary notices contained in the original Webinar Materials are retained on any copies of the Webinar Materials. Registrant will keep all Webinar Materials confidential, and will not sell, auction, loan, rent, give away, describe, summarize, or otherwise reveal the Webinar Materials or their contents, to any other person or entity. Any breach of these Terms of Use automatically terminates your authorized use of the Site and the license to use the Webinar Materials.

By registering for a webinar, consent is given for application details to be provided to a third party to set up the webinar.  Such third policy may have policies which apply to use of their service and you are required to adhere to such policies.

DISCLAIMER OF WARRANTY FOR SERVICES

We attempt to be as accurate as possible in the information provided on the Site and as any part of the Service including any webinars provided by us. However, we do not warrant that the content of any Service is accurate, complete, reliable, current, or error-free.

THE SERVICES MADE AVAILABLE TO YOU THROUGH THE SITE ARE PROVIDED BY AGR ON AN "AS IS" AND "AS AVAILABLE" BASIS. AGR MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SITE OR OTHER SERVICES PROVIDED BY AGR.

TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, AGR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO THE SERVICES. AGR DOES NOT WARRANT THAT THE SITE OR THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. AGR WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THE SITE OR ANY SERVICE, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES.

LIMITATIONS OF LIABILITY

AGR does not have any liability whatsoever for the unavailability of the Site or any Services. AGR shall also not have any liability for any delays or service interruptions caused by us, any third party acts or any other web host provider or the Internet infrastructure and network external to the Site, or for inaccurate information or failure to update information provided via the Site.  IN NO EVENT SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUE IN CONNECTION WITH YOUR USE OF THE SITE OR THE SERVICES PROVIDED VIA THE SITE, REGARDLESS OF WHETHER WE KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES. Governing Law and Jurisdiction

The Site is managed and controlled by us from our offices in Pennsylvania. It can be accessed from the United States, as well as from other countries around the world. As each of these places has laws that may differ from those of Pennsylvania, by accessing the Site, you agree that these Terms of Use and your use of the Site shall be governed in all respects by the internal substantive laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws provisions. Any claim brought by you against us arising out of or relating to these Terms of Use, the Privacy Policy or the Site shall be brought within six (6) months of the event out of which such claim or action arose, and shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted exclusively in Pittsburgh, Pennsylvania, and judgment on the arbitration award may be entered into any court having jurisdiction thereof.
